BORGO POGGIO DEI FIORI HOLIDAY FARM

​

These General Rental Conditions apply to reservations and agreements regarding the apartments in Borgo Poggio dei Fiori, located at Località Poggiolo, 15, 12070 Castelletto Uzzone CN (Cuneo, Piedmont, Italy).

In these General Rental Conditions, the term "tenant" means the person who enters into an agreement with the Landlord regarding the rental of an apartment or the entire Borgo.

 

These General Rental Conditions apply regardless of your (prior) reference to any of your own terms and conditions or other general conditions. We reject all general conditions to which you refer or which you use. Agreements deviating from these General Rental Conditions are only valid if agreed in writing.

 

Reservation

We only accept reservations from persons aged 18 or older. Reservations made by persons under this age are therefore not valid.


Terms and Conditions
1. RENTAL AND LEASE

  • The parties hereby enter into a rental and lease agreement for an apartment or holiday home located in Castelletto Uzzone, hereinafter referred to as "the rented property."

  • This agreement concerns the rental of an apartment or holiday home for recreational use, which is short-term by nature.

  • Inventory is included according to the specified list, which is attached to this contract.

  • The rented property may be occupied by no more than 12 people. The tenant is not permitted to (sub)let or allow the use of the rented property, in whole or in part, to others.

  • Pets (including small pets) are permitted in the rented property for a small fee. (See house rules.)

  • The rental price is published on the website www.weekjepiemont.nl or www.weekinpiedmont.com and will be adjusted annually.

  • The rental price covers the use of the apartment or holiday home, including the fixed inventory, gas, water, and electricity, bed linen (duvets, pillows, duvet covers, and (fitted) sheets), bath linen, and kitchen linen (tea towels), for a maximum of 12 people.

  • Not included in the rental price are the mandatory final cleaning, (small) pets, and the municipal tourist tax.

  • Moving cabinets and beds or taking any of the indoor inventory outside—except, of course, crockery, glasses, and cutlery for your meals outside—is strictly prohibited. Hosting parties, etc., in the rented property is also prohibited.

2. STAY IN THE GUEST HOUSE

  • On the day of arrival, you can generally use the holiday home from 4:00 PM. On the day of departure, you must vacate the holiday home by 10:00 AM. Different times are only possible upon consultation and based on availability.

  • The holiday home is Smoke-free. Smoking is permitted outside on the terrace.

  • Outdoors, an open fire using a fire pit may only be made in the designated area.

  • (Small) pets are allowed indoors.

  • While gas, water, and electricity are included, we request that you use them sparingly.

  • Barbecuing with the provided BBQ is permitted.

  • Subletting or subletting is strictly prohibited.

  • Occupation of the holiday home with more people than agreed upon in the reservation, or the maximum of 14 people applicable to the property, is strictly prohibited without our permission, unless otherwise agreed in writing.

  • The holiday home has a (wireless) internet connection that the tenant can use. The following applies: The tenant is responsible and liable for their own internet use, and any fines imposed (for illegal downloading, uploading, or streaming from the internet) will be passed on to the tenant. The personal data of the tenant/offender will be disclosed upon request. authorities/copyright holder(s). All costs incurred by the landlord related to such infringement will be recovered from the tenant.

 

3. NAME(S) OF TRAVEL PARTICIPANTS

A list of names and addresses of the party will be given to the landlord upon arrival (for the purposes of the municipally mandated accommodation administration and the payment of the tourist tax).

 

4. FINANCES

  • The deposit (40% of the rental price) must be paid no later than 10 days after the final reservation. The remaining balance must be paid no later than the day of arrival.

  • A final cleaning fee applies per stay, depending on the apartment or the entire holiday home.

  • The tourist tax is stated separately on the reservation and must be paid by the landlord to the municipality.

5. DEPOSIT

No deposit is currently required.

 

6. CANCELLATION

  • If, for any reason, the tenant cannot occupy the rented property on the agreed date,

  • If the tenant wishes to accept, or will accept, the tenant must notify the landlord immediately. A telephone notification must be confirmed in writing or by email.

  • If you cancel within 24 hours of your booking being approved, you are entitled to a full refund of the booking amount and the deposit (if applicable). Have you emailed us but not received a response? Don't worry, we will consider the cancellation date to be the date you sent your email.

  • For cancellations up to the 30th day before the start of the stay, the cancellation fee is 10% of the total price.

  • For cancellations from the 30th to the 15th day before the start of the stay, the cancellation fee is 40% of the total price.

  • For cancellations from the 15th day up to the first day of the stay, the cancellation fee is 100% of the total price.

7. LANDLORD'S OBLIGATION

The landlord is obligated to make the rented property available to the tenant in good condition on the agreed date and time.​

8. TENANT'S OBLIGATIONS

The tenant is obligated to use the rented property properly and to leave it in good condition, neat, and tidy.

 

9. DAMAGE

The tenant is liable for damage to the rented property, including damage to or loss of (part of) the inventory, caused during the rental period, unless the tenant can demonstrate that the damage is not attributable to them, their family members, or guests. The amount paid out under any insurance policy will be deducted from the damage claim.

 

10. REPAIR COSTS

The costs of normal maintenance and repair of defects are the landlord's responsibility. If defects occur, the tenant must notify the landlord immediately.

 

11. LANDLORD'S BREACH OF PERFORMANCE

  • If the landlord fails to fulfill their obligations, the tenant has the right to demand performance and/or compensation. If the breach of contract gives sufficient grounds to do so, the tenant has the right to terminate the agreement without judicial intervention. If the tenant wishes to exercise this right, they must notify the landlord immediately in writing and with reasons. In that case, the landlord will immediately refund the rent in full or in part, depending on the nature and duration of the breach. The tenant retains the right to compensation.

  • Please note that the landlord cannot be held responsible for any disruption, change, or impediment to the tenant's stay if this is the result of unforeseen or insurmountable events beyond their control (in particular: RIVM measures regarding Covid-19). The landlord cannot be held responsible for inconveniences caused by the work of third parties, such as municipalities, provinces, gardening companies, etc.

  • The landlord disclaims any liability for loss, theft, or damage to luggage, personal belongings, or vehicle, as well as for costs resulting from not reaching the holiday home on time due to the delay.

12. TENANT'S BREACH OF PERFORMANCE

  • If the tenant fails to pay the rent by the due date or fails to fulfill other obligations under this agreement, the landlord has the right to demand performance and/or compensation.

  • If the breach of contract gives sufficient grounds for doing so, the landlord has the right to terminate the agreement without judicial intervention. If the landlord wishes to exercise this right, they must immediately notify the tenant in writing and with reasons. The landlord retains the right to compensation.

13. CHANGES

We reserve the right to change our privacy policy at any time. The changes will take effect on the announced effective date.
